Welcome to DrivePeak. These Terms and Conditions (“Terms”) govern your use of our mobile application, DrivePeak, available for users across Canada and the United States.
By using DrivePeak, you agree to be bound by these Terms. If you do not agree, please do not use the app.
1. Use of Our App
DrivePeak provides free learning materials for driving theory (knowledge) tests based on publicly available official government handbooks and resources.
The app includes:
- Digital versions of official handbooks
- Flashcards
- Practice/mock tests
DrivePeak is intended solely for educational purposes and should not be considered an official or definitive source for passing any government-regulated driving exam.
2. No Warranties
While we strive to ensure that the information provided is accurate, DrivePeak makes no guarantees or warranties about:
- The correctness, completeness, or reliability of the content
- The success of users in passing any driving tests
- The continuous availability or error-free operation of the app
The official government sources may contain errors, may be outdated, or may differ by jurisdiction.
We are not responsible for any inaccuracies that may exist in the handbooks, materials, or practice questions derived from them.
Use of the app is at your own risk.
3. Limitation of Liability
To the maximum extent permitted by applicable law:
- We are not responsible for any damages, losses, or issues arising from the use of our app, including (but not limited to) failure to pass a driving test, misinterpretation of information, or misuse of our content.
- We disclaim any liability for errors, inaccuracies, omissions, or outdated material sourced from official public documents.
- We are not liable for any indirect, incidental, consequential, or punitive damages related to your use of the app.
4. User Responsibilities
- Users must verify information against the latest official sources provided by their respective province, territory, or state government before relying on it.
- DrivePeak does not replace studying the official handbooks, attending driver education programs, or fulfilling any legal requirements.
5. Intellectual Property
All learning materials compiled within DrivePeak, including flashcards and mock tests, are either:
- Publicly available content
- Content created and compiled by DrivePeak
All rights to our original compilations and features are reserved.
6. Modifications to the App or Terms
We may update or modify the app, its features, and these Terms at any time.
When changes occur, we will update the “Effective Date” and, if necessary, notify users within the app.
Your continued use of DrivePeak after changes are posted constitutes your acceptance of the updated Terms.
7. Governing Law
These Terms are governed by the laws of Canada provinces, US states without regard to conflict of laws principles.
